FAQs

Do I need a lawyer to get a green card? +

You can technically apply for a green card without an immigration attorney, but choosing legal guidance helps move things along more smoothly. A lawyer can review your paperwork and help you complete Form I-485 correctly. They can also ensure that you submit every required document on time.

Because permanent residence applications involve strict rules and detailed documentation, even small mistakes in your application can cause delays or denials. With an immigration attorney, you have added confidence that your case stays on track and error-free.

Can I challenge a deportation order? +

Yes, but you need to act fast because once certain deadlines pass, it becomes much harder (or sometimes impossible) to appeal or reopen the case.

Talk to a deportation lawyer who can review your order and determine whether you can appeal. They can help you file a motion to reopen or apply for some form of relief, as well as represent you in trying to stop the removal.

What employment-based visa categories can my business use? +
  • EB-1 visas allow you to employ individuals with extraordinary ability in fields like science and the arts, as well as outstanding professors or researchers
  • EB-2 visas let you work with professionals with advanced degrees or exceptional ability in areas such as science, business, or the arts
  • EB-3 visas allow you to hire skilled workers and professionals with a US bachelor’s degree (or equivalent), as well as certain other workers

Each category has its own eligibility requirements and documentation standards. With an immigration attorney, you can choose the right path that fits your business.

When can I apply for US citizenship after getting a green card? +

You need to be a green card holder for 5 years to be eligible for naturalization. However, you may qualify sooner if you’re:

  • Married to a US citizen – You may apply for naturalization after three years as a permanent resident
  • An individual who received your green cards through VAWA protections – You may qualify for naturalization after 3 years.

If you served honorably in the US armed forces for at least one year, you may also qualify under special rules.

Note that you don’t always need to wait until the exact anniversary date. In many cases, you can submit your N-400 application up to 90 days before you reach the required residency period.
